The contractor, who built the collapsed Synagogues six-storey building, Mr. Akin Fatiregun, has said he is sick and currently receiving treatment at the Lagos State University Teaching Hospital, Ikeja, Lagos State.
He therefore asked the coroner, Magistrate O.A. Komolafe, who is investigating the circumstances surrounding the September 12 building collapse to allow him get well before coming to give testimony as he had been requested to do.
Fatiregun, who was billed to appear before the coroner on Friday, made the request at the proceedings through his legal representative, Serah Edoha.
Edoha assured Komolafe that Fatireguns failure to appear in court was not done in deliberate disobedience to the courts order.
To support her claim, she tendered a medical report from LASUTH.
But the admissibility of the report subsequently became a subject of debate amongst the various counsel who appeared in court.
Reacting to the development, counsel for the Lagos State Government, Mr. Akingbolahan Adeniran questioned the authenticity of the medical report.
Besides, Adeniran said the contractor ought to have sent a member of his team to appear in court in view of time.
But the counsel for the Synagogue Church Of All Nations, Mr. Olalekan Ojo argued that it was against the rule for a witness to delegate another person to represent him in court.
Ojo, while urging the court to admit the medical report as the evidence that Fatiregun was sick, maintained that LASUTH as a hospital has unquestionable reputation.

NEW YORK They may share the same long beards, curly pe'ot (sidelocks) and come from a similar Hasidic background, but don't call Zusha the next Matisyahu.
While they site the Jewish reggae singer as one of their inspirations, this bearded band of neo-Hasidic hipsters are shaking up the music industry with their wordless melodies aimed at bringing people of all faiths closer to God.
"We're playing music for unity, for connection, to bring all of the inspiration we got from our Judaism [to others] in a more universal way," lead singer Shlomo Gaisin told FOX411.
The band knew their tunes were making a mark when their first EP debuted at No. 9 on Billboard's World Music chart.
"My dad was freaking out," guitarist Zachariah Goldshmiedt recalled. "He made a cut out of Billboard, but he had to cut out a picture of Nicki Minaj because it was inappropriate."
Gaisin and his bandmates follow the traditions of Hasidism, a sect of Judaism which places on emphasis on practicing Jewish law and living every day life with added spirituality.
"Hasidism is-- it's a celebration of life," explained Gaisin. "It's making sure that our eyes aren't focused on the darkness of the world, but on the lightness of world even if it's tiny."
While most of Zusha's songs contain no lyrics, they are not voiceless. Gaisin's voice can be heard singing repetitive sounds to convey emotion such as "bim-bim-bum." The style of singing is typical of Hasidism.
"We do like to veer to the wordless because of it's universalism," explained percussionist Elisha Mlotek.
"Well the wordless in it's very nature relatable to all people because there's not specific language that connotes a connect to one specific people," added Gaisin.

A New York lawmaker says the frightening, Photoshopped image was sent to his office by mail.
A New York county lawmaker and Hasidic Jew claims to have received a chilling piece of hate mail - a Photoshopped image of his head atop an Islamic State captive about to be beheaded.
Rockland County Legislator Aron Wieder said he got the frightening missive on Monday, and has notified police. The image shows Weiders face on the body of a man dressed in orange, kneeling in the desert before a knife-wielding Islamic State fighter. The scene appears similar to ones seen in terror videos that showed journalists and an aid worker who were beheaded. Wieders name appeared in English text below Arabic writing.
Rockland County Sheriff Louis Falco said authorities are taking the threat seriously, and it is under investigation with the police department as well as their joint terrorism task force.
State Assemblyman Dov Hikind, a Jewish activist who has long represented Brooklyn at the Statehouse in Albany, said the doctored photo is the work of a sick creep.
We dont know who did this but were going to find out, said Hikind, who immediately phoned Wieder upon hearing the news. The Jewish community worldwide is celebrating the miracle of Chanukah and some sick individual chose this time to send this message to Wieder and our community. Were taking the message seriously and I am calling on both local and Federal authorities to do the same-to investigate thoroughly as well as provide security for Aron Wieder and his family. The people responsible for this must be arrested and dealt with.
Rabbi Yaacov Behrman, executive director of The Jewish Future Alliance, echoed Hikind's concerns.
"Whoever did this must be held accountable for their actions," Behrman said. "I commend the local authorities, who have said that they are taking this despicable act seriously."
